A. FORMATION OF THE CONTRACT AND CARE OF THE VEHICLE
A.1 A rental enquiry submitted through the EAZY RENT website is initially non-binding. The acknowledgement confirms receipt of the enquiry and is not a binding booking confirmation. A rental agreement is concluded when EAZY RENT has given a binding confirmation of availability and the agreed terms and the required contractual acceptance has taken place. A.2 If an offer or prepared rental agreement is provided through a personal customer link, the customer may review the specified details and terms, complete their information and sign the displayed version of the agreement. EAZY RENT's signature is not applied automatically. For an in-person rental, the parties conclude the rental agreement at vehicle handover. A.3 Under section 312g(2), point 9 of the German Civil Code (BGB), there is generally no statutory right of withdrawal for a vehicle rental agreed for a specific date or period. The agreed cancellation terms remain unaffected. A.4 The renter confirms that they can pay the agreed rental price and security deposit. They must use and care for the vehicle properly, check its roadworthiness to the extent reasonably expected and secure it appropriately whenever it is left unattended. A.5 Smoking is prohibited in the vehicles. If additional cleaning is necessary, the cleaning charges agreed before the rental may be claimed. Where a fixed charge has been agreed, the renter may prove that no loss, or a substantially lower loss, was incurred. A.6 Technical faults and operating problems must be reported to EAZY RENT immediately. Repairs generally require the rental company's express approval and must be carried out by a suitable specialist workshop for the vehicle brand. Prior approval is not required if, before work begins, the workshop gives a binding confirmation that the cost will not exceed EUR 80. Documented repair costs actually paid will be reimbursed against an original receipted invoice, provided the renter was not responsible for the fault or the work was required for road safety. A.7 The vehicle is supplied with a full tank and must be returned with a full tank. Any fuel shortfall will be charged at the refuelling rates agreed in advance. The renter bears the cost of operating fluids used during the rental, in particular engine oil and windscreen washer fluid or antifreeze. A.8 For digital signing, the version shown, the details confirmed by the customer, the signature image and the submission time are recorded. Personal customer links must be kept confidential. A submitted signature must not subsequently be altered in substance; changes require a new, clearly identified agreement. A simple on-screen signature is not represented as a qualified electronic signature.
B. DRIVERS, DOCUMENTS AND PERMITTED USE
B.1 At handover, the renter must present an original valid identity card or passport together with proof of address, and an original driving licence valid in Germany. Every named driver must have held the relevant driving entitlement for at least one year. The minimum age agreed for the particular vehicle also applies; selected vehicles are available from age 19. B.2 The agreed means of payment must be available at handover. Cash payment is possible; a credit card is not compulsory. Any payment method issued to a named individual must belong to the renter. If the required documents or agreed payment cannot be provided, EAZY RENT may withhold handover and withdraw from the agreement where permitted by law. Losses for which the renter is responsible remain recoverable. B.3 If there are reasonable doubts about identity, a valid driving entitlement or ability to pay, EAZY RENT may withhold handover until these matters have been adequately clarified. B.4 Only people named in the rental agreement may drive the vehicle. Additional drivers must be agreed and entered in the agreement before driving; any charges must be specified in advance. The age and driving-licence requirements apply to every driver. The renter is responsible for the conduct of people to whom they entrust the vehicle to the extent required by law. B.5 The vehicle is intended for use on public roads. Prohibited uses include motorsport and top-speed events, vehicle testing, driver-safety training, driving on race circuits, commercial passenger transport, sub-rental and use to commit criminal offences. B.6 Travel abroad is permitted only in the countries agreed in advance. EAZY RENT's prior approval is required for other countries; additional conditions may be agreed. B.7 Stability and driver-assistance systems, in particular ESP or ESC and traction control, must not be disabled. Launch-control starts are prohibited. These requirements are also contractual obligations relating to any agreed limitation of liability. B.8 Serious breaches of the above requirements may entitle EAZY RENT to terminate without notice or withdraw from the agreement where the legal requirements are met. EAZY RENT's claims for damages remain unaffected where the renter is responsible for the breach. B.9 Vehicles may be equipped with GPS tracking. Location data is processed in accordance with applicable data-protection rules and the privacy information provided for that purpose.
C. RENTAL PRICE, PAYMENT AND SECURITY DEPOSIT
C.1 The total rental price comprises the agreed base price and any expressly agreed additional services. These may include additional drivers, delivery, collection and, where applicable, location surcharges. The amounts and scope are stated in the offer or rental agreement. C.2 The rental price is generally payable for the entire agreed period. Late collection or early return does not automatically entitle the renter to a refund. Unless otherwise agreed in the rental agreement, the rental price is due at the start of the rental. C.3 The agreed security deposit is payable in addition to the rental price. It is held separately and depends on the vehicle and the agreed eligibility requirements. If the renter resides outside Germany AND does not hold a German driving licence, an increased deposit of EUR 5,000, equal to the insurance excess, applies. If only one of these two conditions applies, this rule alone does not increase the deposit to EUR 5,000. C.4 Rental charges, additional services and the deposit are paid using the method agreed in the rental agreement. Automatic debits from a bank account or payment card require a separate valid authorisation. These terms do not make a credit card compulsory. C.5 If payment is overdue, the rental company has the rights provided by law. Termination without notice may be possible where the statutory requirements are met.
D. INSURANCE AND CLAIMS HANDLING
D.1 Motor third-party liability insurance provides cover of up to EUR 100 million for personal injury and property damage. Cover is limited to a maximum of EUR 8 million per injured person. The geographical scope of cover is limited to Europe. The third-party liability insurance excess is EUR 1,000 per claim. The comprehensive insurance excess agreed for damage to the rental vehicle is stated separately in the rental agreement. D.2 Claims by third parties must not be admitted or settled, in whole or in part, without EAZY RENT's prior approval. After an incident, the renter and authorised drivers must take reasonable steps to prevent or reduce loss, follow reasonable instructions and cooperate with investigations and settlement. D.3 In handling claims, EAZY RENT may, in its proper discretion, defend or settle claims made against the renter or driver in their name and make the declarations necessary for that purpose. EAZY RENT must be notified immediately of out-of-court and court claims. If EAZY RENT takes responsibility for conducting proceedings, the necessary authorisations, information and documents must be provided to the appointed lawyer.
E. ACCIDENTS, THEFT AND DUTIES TO COOPERATE
E.1 The police and EAZY RENT must be notified immediately after an accident, theft, fire, collision with an animal or other damage. This also applies to minor damage and to an accident caused by the driver without third-party involvement. E.2 Any damage to, or loss of, the vehicle or any part of it must be reported to EAZY RENT immediately in writing or text form, including all known details. An accident report must be completed fully and truthfully. E.3 The renter and driver must permit all reasonable steps needed to establish the facts, answer questions about the incident fully and truthfully and remain at the scene until the necessary findings have been made or EAZY RENT has had a reasonable opportunity to make them.
F. LIABILITY OF THE RENTER AND DRIVERS
F.1 Liability for damage to or loss of the vehicle and breaches of contractual duties is generally governed by law. The renter and driver are not liable for a breach for which they are not responsible. F.2 Any agreed contractual limitation of liability for accident, loss and fire is based on the principles of comprehensive motor insurance. It covers the renter and authorised additional drivers named in the agreement. The excess specified in the rental agreement applies to each separate incident. F.3 The contractual limitation of liability does not apply to deliberately caused loss. Where loss is caused by gross negligence, the extent of the limitation may be reduced according to the seriousness of the fault. The same applies to deliberate or grossly negligent breaches of contractual obligations, particularly duties to cooperate after an incident. If the breach did not cause the incident, affect the establishment of the facts or affect the extent of the payment obligation, the limitation remains in effect; this does not apply to fraudulent conduct. Supplementary legal rules, particularly those governing the burden of proof, remain unaffected. F.4 The limitation of liability concerns damage to the vehicle during the agreed rental period. Other demonstrable losses that are legally recoverable, such as recovery costs, reduction in value or loss of rental income, may also be claimed where the legal and contractual requirements are met. The deposit does not limit the amount of a valid damages claim. F.5 The renter bears fines, penalties, fees and legally recoverable costs arising from traffic offences, regulatory offences, interference with possession or other unlawful conduct caused by the renter or people to whom they have entrusted the vehicle. A handling charge agreed in advance may be charged for related enquiries from public authorities. The renter expressly retains the right to prove that no cost or loss, or a substantially lower cost or loss, was incurred. Any higher loss that can be proved may also be claimed. F.6 An accident is a sudden event involving mechanical force acting directly on the vehicle from outside. Damage caused solely by braking, operation or mechanical breakage is not accident damage. Examples may include damage caused by shifting loads, incorrect fuel, incorrect gear selection, torsion, misuse or excessive strain. F.7 The renter must pay tolls and road-use charges fully and on time. They must indemnify EAZY RENT against corresponding claims resulting from their use or the use of anyone they allow to use the vehicle. F.8 Unauthorised users are not covered by the contractual limitation of liability. The German Insurance Contract Act and the relevant motor insurance conditions also apply. Multiple renters are jointly and severally liable for joint obligations arising out of or in connection with the rental agreement.
G. LIABILITY OF EAZY RENT
G.1 EAZY RENT is liable in accordance with the law for deliberate acts, gross negligence and culpable injury to life, body or health. For other ordinary negligence, liability arises only for a breach of an essential contractual duty and is limited to foreseeable loss typical of the agreement. Mandatory statutory liability remains unaffected. G.2 EAZY RENT is not liable for items left in the vehicle after return, unless liability arises from a deliberate act, gross negligence or another mandatory legal requirement.
H. RETURN AND LATE RETURN
H.1 The rental ends at the agreed time. Continued use does not automatically extend it; section 545 BGB is excluded. Any extension must be agreed with EAZY RENT in advance. H.2 The vehicle, documents, accessories and all supplied keys must be returned at the agreed time and place in the condition required by the agreement. Excessive dirt or odours may result in additional cleaning costs that are legally recoverable. Any agreed fixed charges and the right to prove no loss or substantially lower loss must be taken into account. H.3 If the vehicle or key is returned late, the following scale applies: no late charge for a delay of up to and including 29 minutes; EUR 200 for a delay of 30 to 59 minutes; from 60 minutes, one additional rental day is charged for each additional day or part of a day. A higher demonstrable loss may also be claimed, with amounts already charged credited against it. The renter expressly retains the right to prove that no loss, or a substantially lower loss, was incurred. Mandatory statutory rules remain unaffected. H.4 Navigation destinations, paired mobile devices, contacts and other personal entries may be stored in the vehicle. The renter should delete this information and disconnect devices before return. EAZY RENT's statutory data-protection duties remain unaffected. H.5 Multiple renters are jointly and severally liable for return and related compensation obligations. H.6 Collection and return may be documented in a report showing mileage, fuel level and marked damage. Known or manually recorded pre-existing damage is identified accordingly. A damage marker or acknowledgement of receiving the report does not, by itself, constitute an admission of liability or an automatic payment obligation. Objections can be recorded in the report. Recording a repair changes the current vehicle condition, not earlier contract or report versions. A customer copy may be provided as a PDF or sent by email.
I. CANCELLATION AND FAILURE TO COLLECT
I.1 A binding rental may be cancelled up to 72 hours before the start according to the following scale: at least four weeks before the start, 30%; less than four weeks but at least two weeks before the start, 60%; less than two weeks but at least 72 hours before the start, 85% of the total rental price. The time EAZY RENT receives the cancellation is decisive. The total rental price is the agreed amount including fees and extras. I.2 Costs saved are reflected in these fixed charges. The renter expressly retains the right to prove that no loss, or a substantially lower loss, was incurred. Income from re-rental and costs saved will be taken into account as required by law. Statutory claims apply to later cancellation; these terms do not introduce an additional independent cancellation charge for it. I.3 If the renter does not attend at the collection time, EAZY RENT will hold the reservation for two hours. The vehicle may then be rented to someone else. If the renter is responsible for the failure to collect, the total rental price may be claimed after taking account of costs saved and any re-rental. The renter expressly retains the right to prove no loss or substantially lower loss. I.4 Where delivery away from the EAZY RENT location is agreed, the maximum waiting time at the agreed handover location is 30 minutes. The vehicle may then be returned to Munich-Bogenhausen. A further handover must be arranged with EAZY RENT during business hours.
J. TERMINATION AND EARLY ENDING
J.1 Either party may terminate the agreement where the legal requirements are met. A serious reason for EAZY RENT to terminate without notice may include substantial payment problems, dishonoured payments, relevant enforcement measures, serious neglect or misuse or unlawful use of the vehicle. The statutory requirements and circumstances of the individual case always apply. J.2 After the agreement has validly ended, the vehicle, vehicle documents, accessories and all keys must be returned to EAZY RENT immediately, unless otherwise agreed.
K. PAYMENT AUTHORISATION AND SET-OFF
K.1 Rental-related claims will be debited only on the basis of a separate valid payment or direct-debit authorisation. Cash payment remains available. K.2 Set-off is permitted against counterclaims that are undisputed or established by a final court judgment. Statutory rights of set-off and retention, particularly those arising from the same contractual relationship, remain unaffected.
L. FINAL PROVISIONS
L.1 Individually agreed provisions take precedence. Additional arrangements should be recorded in the rental agreement or in text form for clear documentation. The statutory priority of individual agreements remains unaffected. L.2 EAZY RENT does not participate in dispute resolution before a consumer arbitration body unless legally required to do so. L.3 If the renter is a businessperson within the meaning of German commercial law, a legal entity under public law or a special fund under public law, Munich is the agreed place of jurisdiction where legally permissible. Otherwise, statutory jurisdiction applies. L.4 The contract language is German. Translations are provided for information. In the event of a discrepancy, the German version prevails to the extent permitted by law.
